1. Website "app.parkavimasmieste.lt" and these Terms and Conditions
1.1. The owner and operator of the website "app.parkavimasmieste.lt" (hereinafter referred to as the Website) is UAB "DK investicijos" (hereinafter "Parkavimas Mieste"), address Dariaus ir Girėno g. 8, LT-02011, 434 box, email address [email protected]. The Website is designed for payment for the use of paid parking lots, administered by "Parkavimas Mieste".
1.2. The use of the Website is subject to rules outlined in these Terms and Conditions.
1.3. Information about the processing of personal data while using the Website can be found in "Parkavimas Mieste" “Website Privacy Notice”, at https://www.parkavimasmieste.lt/en/website-privacy-policy/272.

2. User account, account information
2.1. To use the Website, it is necessary to create a user account.
2.2. The user account must be linked to at least one valid payment card, which will be used for payment for the use of car parking lots. The payment card is the only method of payment when using the Website. The fee for using the parking lot will be automatically deducted from the payment card (without additional user
authorization) upon using the parking lot. By linking a payment card to your account, you agree to the automatic withdrawal of funds from the payment card associated with your account.
2.3. The user account must be linked to the user's email address and phone number, through which information related to service provision will be sent (e.g., important information about changes in rates may be sent to the email address, and information about a failed fund deduction from the payment card may be sent via SMS). Direct marketing to the provided contacts will be sent only if the user has given appropriate consent on the Website.
2.4. You are responsible for the data in your user account. When creating a user account, you must provide accurate, truthful, and up-to-date information. If the data you provided when creating a user account changes, you must promptly update the information. You are also responsible for the confidentiality and non-disclosure of your account login credentials to third parties. "Parkavimas Mieste" is not responsible for any potential negative consequences if incorrect data is added to the user account, if the data is not updated when changed, or if the user does not ensure the confidentiality of login credentials.

3. Payment procedure
3.1. In the "Parking lots" section of the Website (also, alternatively, in the website “parkavimasmieste.lt”), you can find information about all paid parking lots possibility to purchase a long-term subscription, and other relevant information. Additionally, information about parking conditions specific to a particular lot can be found on informational boards located physically at that specific lot.
3.2. Payment for using a paid parking lot administered by "Parkavimas Mieste" can be made through the Website or (if applicable) at the physical payment machine located at the lot. If you choose to pay through the Website, a fixed Website service fee of 20 euro cents is applied to each payment transaction. The Website service fee is applied each time you pay for services through the Website, its amount (20 euro cents) is fixed and does not depend on the amount you pay with a specific payment for a specific parking service.
3.3. When paying through the Website, funds are automatically deducted from the payment card linked to the user's account, without additional user authorization. The automatic deduction of funds is initiated when the
user attempts to exit the parking lot (arrives at the exit of the lot). If the deduction of funds from the payment card is unsuccessful (e.g., insufficient funds on the card), the user receives an SMS message about a failed payment.
3.4. Upon logging into the Website user account, in the "My Invoices" section, users can find and download invoices for paid services.

4. Other provisions
4.1. All rights to the Website (including intellectual property rights to the content, graphic elements, software of the Website) belong exclusively to "Parkavimas Mieste". Users are not granted any intellectual property rights or other rights, except for the right to use the Website for its intended purpose (to pay for the use of paid parking lots administered by "Parkavimas Mieste"). It is forbidden to use the Website for any purpose other than its intended purpose (e.g. to copy, distribute, modify, create derivative products, or otherwise use the Website or its content for purposes other than intended).
4.2. Users are responsible for their actions using the Website. Users must use the Website legally and ethically, including but not limited to using their account, payment methods, and communication channels they have the right to use, and avoiding any illegal, fraudulent, or unethical use of the Website. "Parkavimas Mieste" is not responsible for any negative consequences that may arise from illegal or unethical actions by users.
4.3. "Parkavimas Mieste" has the right to suspend service provision and/or block a user account, including cases where illegal or unethical user activity is detected or suspected.
4.4. "Parkavimas Mieste" has the right, at its discretion, to change the design, functionality, information, or suspend the operation of the Website.

4.6. “Parkavimas Mieste" has the right to refine, update, or change these rules if the activities of “Parkavimas Mieste” changes, as it relates to Website functioning, administration or pricing and such changes affect these Terms. If essential commercial conditions for using the Website are changed (e.g., introducing or changing administrative fees for using the Website, changing the payment procedure and methods, etc.), users will be notified of such changes in advance by email. The date of latest update is indicated at the beginning of these Terms and Conditions.
